Access to information

Subject to the exceptions set out therein, the Act respecting Access to documents held by public bodies and the Protection of personal information grants you, in particular, the following rights:

  • Access to documents held by a public body in the exercise of its functions, as well as access to your personal information;
  • Protection of your personal information, including its confidentiality, collection, use, release, and keeping;
  • The correction of your personal information if it is incomplete, inaccurate or equivocal, or if the collection, release or keeping of the information is not authorized by law.

As regards request for access, a public body has a maximum of 20 days to answer a request, beginning from the date of receipt. If the request cannot be processed within that time limit without impeding the normal course of operations of the public body, the person in charge may, before the expiry of that time limit, extend it by not more than 10 days and must give notice of the extension in writing to the applicant within that same time limit.

Upon receiving an request for access (which may be written or verbal), the person in charge of access of the public body must send the applicant a written notice. In addition to the date of receipt of the request, the notice must indicate the time limit within which the public body must respond. The notice must also mention the review available where the time limit for responding is not complied with or where the applicant is dissatisfied with the response received.

Every person whose written request has been refused, in whole or in part, by the person in charge of access to documents or the protection of personal information may apply to the Commission d’accès à l’information (the “Commission”) for a review of the decision, or for a review of any decision concerning the time prescribed for processing the request, the mode of access to a document or information, or the fee payable.

The application for revision must be made within thirty days of the date of the decision or of the time granted by this Act to the person in charge for processing a request. However, the Commission may, for any serious cause, release the applicant from a failure to observe the time limit.

Request for personal information or Request for correction

Except in certain cases, you have the right to be informed of any personal information concerning you that is held by a public body. You may request access to such information or request its correction if it is incomplete, inaccurate or equivocal.

Access to personal information is generally free of charge. Fees may apply for transcription, delivery and reproduction of documents.

Request for access to an administrative document

Except in certain cases, you have the right of access to documents held by CGTSIM in the exercise of its functions.

Access to a CGTSIM document is generally free of charge. Fees may apply for transcription, delivery and reproduction of documents.
